Conditions of Participation in Events and Digital products of MAITREA House of Personal Development (Commercial Conditions) / seminare.maitrea.cz

The provider of the seminar services and electronic services and publications (online seminars, recordings and e-books) is MAITREA inspirace srdcem, s.r.o., ID No. 09761942, registered office Týnská ulička 1064/6, Staré Město, 110 00 Prague 1, file No. C 342044 with the Municipal Court in Prague.

The Participant is a person interested in the object of purchase and by registering and again by participating in the seminar and/or individual lesson and/or therapy (together and individually hereinafter referred to as "On-site Event") and/or by participating in the online seminar (hereinafter referred to as "Online Event" ) agrees to the terms and conditions set out below and undertakes to comply with them.

The Purchaser is the person interested in the subject matter of the purchase, which for the purposes of these terms and conditions are electronically provided audio/video recordings or e-books (collectively and individually referred to as "Digital Products"). By purchasing the subject matter of the purchase, the Purchaser agrees to the terms and conditions set out below and undertakes to comply with them.

The amount of the Course Fee for On-Site Events and Online Events shall be made in accordance with the Price Act or by contract. The Provider is subject to value added tax. The course fee is payable immediately, unless otherwise stated on the web interface or in the invoice. The Participant's obligation to pay the subject price is only fulfilled when the total identifiable amount is credited to the Provider's account. An apparent error in the pricing (e.g. due to a misrepresentation, a typo during entry, etc.) is not a determining factor. If the Participant has placed an order at this price, the Provider will be asked to agree to the corresponding price immediately. In the event of disagreement or failure to agree within 3 days, the order is not considered binding. 

The amount of payment for Digital Products is formed according to the Price Act or contractually. The Provider is subject to value added tax. Payment is due immediately, unless otherwise stated on the web interface or in the invoice. The Buyer's obligation to pay the subject price is only fulfilled when the total identifiable amount is credited to the Provider's account. An apparent error in the valuation (e.g. due to a misrepresentation, a typo in the input, etc.) is not a price determinant. If the buyer has placed an order at this price, the provider is immediately asked to agree to the corresponding price. In the event of disagreement or failure to agree within 3 days, the order is not considered binding. 

Events on site


1. Registration and payment for ON-SITE EVENTS

Application for an On-Site Event is made via the online form located on our website. This online form may also be completed by an employee of MAITREA Inspiration by Heart, Ltd. according to the participant's personal or telephone instructions, in which case the participant will confirm his/her interest in participating in the Event via an email sent to the email address provided by the participant. 

Registration for the Event and payment of the course fee is done in one of the following ways:

1.1. on-site event with payment of the course fee on the day of the Event

Completion and submission of the online application form creates a binding reservation of a place. The course fee is payable in full in cash (or by card) on the day of the Event, preferably up to 20 minutes before the start of the Event.

1.2 On-site events with full payment of the course fee in advance

Completing the online application form and submitting it will result in a non-binding 4-day booking of a place. Registration is confirmed by payment of the full course fee to our account. The participant will receive the account number and variable symbol by e-mail after completing the online application form.

1.3 On-site event with advance payment

Completing the online application form and submitting it creates a non-binding 4-day reservation for a place. The registration is confirmed by the payment of the stipulated advance payment of the course fee to our account. The participant will receive the account number and variable symbol by e-mail after completing the online application form.

2. Cancellation conditions for ON-SITE EVENTS

2.1 On-site events with a course fee of up to 1000 CZK

If the participant cancels EARLY than 1 month before the start of the Event, the paid course fee will be refunded in full of the received payment. 

If the participant cancels LESS than 1 month before the start (or during or after the end) of the Event, either by his/her own decision or for unexpected reasons (e.g. illness or family matters), the full amount of the paid tuition fee is non-refundable and non-transferable to another Event.

Upon prior notice, a substitute may take the place of the Participant. The substitute will be provided by the participant.

2.2. On-site events with course fees over 1000 CZK

If the Participant cancels BEFORE 1 month prior to the start of the Event, the course fee paid will be refunded in the amount of the payment received. 

If the participant cancels LESS than 1 month before the start of the Event based on his/her own decision or for unexpected reasons (e.g. illness or family matters), the 50% deposit paid is non-refundable and non-transferable to another Event. If the participant has paid the full course fee, 50% of the course fee will be refunded. 

However, if the Participant does not check out until the day of the Event, during the Event or after the Event, the Participant will not be entitled to a refund or transfer of the Course Fee to another Event.

A substitute may take the place of the Participant upon prior notice. The substitute is provided by the Participant.

2.3 On-site Events with a fee of over CZK 8,000

For Events with a fee exceeding CZK 8,000, the deposit paid is non-refundable and non-transferable to another Event.

If the participant cancels EARLY than 1 months before the start of the Event based on his/her own decision or for unexpected reasons (e.g. illness or family matters) and has paid the course fee in full, the course fee will be refunded except the non-refundable deposit.

If the Participant cancels less than 1 months before the start of the Event, either by his/her own decision or for unexpected reasons (e.g. illness or family matters), the full amount of the course fee will not be refunded or transferred.

Upon prior notice, a substitute may take the place of the participant. The substitute will be provided by the participant.

2.4 On-site event with discounted price for 2 persons

If one of the participants cancels EARLY than 1 month before the start of the Event, the full single person fee will be deducted from the discounted amount paid and the difference will be refunded. (e.g. Price for 1 person = 4.900 / Discounted price for 2 persons = 9.000 CZK / Difference to be refunded: 9.000 - 4.900 = 4.100 CZK).

If one of the participants cancels less than 1 month before the start of the Event (by his/her own decision or for unexpected reasons, e.g. illness or family matters), the full price for one person will be deducted from the discounted amount paid. Of the difference, 50% deposit is non-refundable and non-transferable. However, if the participant has paid the full course fee, 50% of the course fee will be refunded. (e.g. Price for 1 person = 4.900 / Discounted price for 2 persons = 9.000 CZK / Difference: 9.000 - 4.900 = 4.100 CZK / To be refunded: 50% of 4.100 = 2.050 CZK).

If both participants opt out, the procedure is as per point 4.2.

If the course fee exceeds CZK 8,000 per person, the procedure is as per point 4.3.

On the day of the start of the Event, during or after the end of the Event, the right to a refund or transfer of the Course Fee is lost. 

Upon prior notification, a substitute may take the place of the Participant. The substitute is provided by the Participant.

2.5 Costs associated with cancellation of the Event:

The Provider shall not reimburse the Participant for any costs associated with cancellation of the Event.

Online events


3. Registration and payment for ONLINE EVENTS

Application for the Online Event is made via the online form located on our website. This online form can be filled in by an employee of MAITREA inspiration by heart, s.r.o. according to the personal or telephone instructions of the participant, provided that in such case the participant confirms via an e-mail sent to the e-mail address provided by him/her that he/she has indeed expressed interest in participating in the Event.

3.1 Online events with full payment in advance

Completing the online application form and submitting it creates a non-binding 4-day reservation of a place. The registration is confirmed by payment of the full course fee to our account. The account number and variable symbol will be sent to the participant by e-mail after completing the online application form.

Access details for the Online Event are sent to the purchaser by email within 3 days after receipt of payment, but no later than before the start of the Event.

3.2 Prohibition of recording the Online Event

The Participant may not make an audiovisual, audio or other recording of the Online Event in any way or otherwise copy or distribute the content of the Event, data about its participants, etc. without the Provider's prior consent.

4. Cancellation conditions for ONLINE EVENTS

4.1 Online Events with a fee of up to CZK 1,000

If the Participant cancels the Online Event less than 1 month before the start of the Event, the paid tuition fee will be refunded to the full amount of the received payment. 

If the participant cancels LESS than 1 month prior to the start (or during or after the end) of the Event, either by his/her own decision or for unexpected reasons (e.g. illness or family matters), the full amount of the course fee paid is non-refundable and non-transferable.

Upon prior notice, a substitute may take the place of the participant. The substitute is to be arranged by the participant.

4.2 Online events with course fees over CZK 1000

If the Participant cancels the Event sooner than 1 month before the start of the Event, the paid tuition fee will be refunded in the full amount of the received payment. 

If the participant cancels LESS than 1 month before the start of the Event, either by his/her own decision or for unexpected reasons (e.g. illness or family matters), the 50% deposit paid is non-refundable and non-transferable. However, if the participant has paid the course fee in full, 50% of the course fee will be refunded. 

No refund or transfer of the Course Fee will be due on the day of, during or after the Event.

A substitute may take the place of the Participant upon prior notice. The substitute shall be provided by the Participant.

4.3 Online events with a course fee of over CZK 8,000

For Events with a fee exceeding CZK 8,000, the deposit paid is non-refundable and non-transferable.

If the participant cancels EARLIER than 2 months before the start of the Event based on his/her own decision or for unexpected reasons (e.g. illness or family matters) and has paid the course fee in full, 50% of the course fee will be refunded. 

If the Participant cancels less than 2 months before the start of the Event, either by his/her own decision or for unexpected reasons (e.g. illness or family matters), the full amount of the course fee will not be refunded or transferred.

Upon prior notice, a substitute may take the place of the participant. The substitute is to be arranged by the participant.

4.4 Online events with a discounted price for 2 persons

If a participant cancels EARLY than 1 month before the start of the Event, the full single person course fee will be deducted from the discounted amount paid and the difference will be refunded. (e.g. Price for 1 person = 4.900 / Discounted price for 2 persons = 9.000 CZK / Difference to be refunded: 9.000 - 4.900 = 4.100 CZK).

If one of the participants cancels less than 1 month before the start of the Event (by his/her own decision or for unexpected reasons, e.g. illness or family matters), the full price for one person will be deducted from the discounted amount paid. Of the difference, 50% deposit is non-refundable and non-transferable. If, however, the participant has paid the full tuition fee, 50% will be refunded (e.g. Price for 1 person = 4,900 / Discounted price for 2 persons = 9,000 CZK / Difference: 9,000 - 4,900 = 4,100 CZK / To be refunded: 50% of 4,100 = 2,050 CZK).

If both participants opt out, the procedure is as per point 4.2.

If the course fee exceeds CZK 8,000 per person, the procedure is as per point 4.3.

On the day of the start of the Event, during or after the end of the Event, the right to a refund or transfer of the Course Fee is lost. 

Upon prior notification, a substitute may take the place of the Participant. The substitute is provided by the Participant.

4.5 Complaints about Online Events due to technical failures on the participant's side

The Provider is not responsible for faults related to slow or faulty internet connection or insufficient software or hardware equipment of the participant. In this case, the right to a refund of the course fee is forfeited.

The participant of the Online Event will be given access to the recording of the Event within 5 working days of the Event, which will allow the participant to view it even in the event of previous technical problems. Access to the recording is limited to 14 days.

The access data to the Event recording is for the personal use of the participant only and it is prohibited to allow access to third parties.

4.6 Costs associated with cancellation of the Online Event:

The Provider shall not reimburse the Participant for any costs associated with the cancellation of the Online Event.

Digital products (Recordings and e-books)

5. Ordering, payment and access for DIGITAL PRODUCTS

Orders for Digital Products are placed through the online form located on our website. This online form can also be filled out by an employee of MAITREA inspiration by heart, s.r.o. according to the personal or telephone instructions of the purchaser, provided that in such case the purchaser confirms via an e-mail sent to the e-mail address provided by him/her that he/she has indeed expressed interest in purchasing the recording or e-book. 

5.1 Payment and delivery of access to the Digital Product

The Buyer has the option in the order to choose the form of payment by credit card via an online payment gateway or by bank transfer.

In the case of payment by bank transfer, the Buyer will receive the account number and variable symbol by e-mail after the online order has been submitted.

Access data or download links are sent to the buyer by email within 3 days after receipt of payment. In the case of payment by credit card, the delivery time of the accesses is linked to the automatic processing of the receipt of payment and the buyer receives the accesses to the Digital Product immediately.

5.2 Duration of accesses and copyright protection of the Digital Product

Access to the audio/video recording is provided via a web browser and is available to the purchaser for a period of 12 months from payment. In the case of an e-book, the purchaser will receive a link to download the file. The link to the file is active for 12 months after payment.

The access data and download links are for the personal use of the purchaser only and it is forbidden to allow access to third parties, including sharing on social networks. Should this be the case, the provider has the right to withdraw from the purchase contract, deactivate the buyer's access data and recover any lost profits or damages incurred.

The buyer is also obliged to prevent the misuse of his/her access data by third parties.

6. Cancellation conditions for DIGITAL PRODUCTS and money-back guarantee

The Buyer has the right to withdraw from the Purchase Agreement within 30 days of payment for the Digital Product. To withdraw from the Purchase Agreement, the Buyer shall send an email to the Provider at seminare@maitrea.cz.

Other arrangements

7. Health and liability

7.1 Health

The event is not a substitute for medical or psychotherapeutic care. In the event that the participant is currently undergoing any kind of treatment (especially psychiatric or psychological work), the participant undertakes to inform the lecturer of this fact and the nature of the difficulties or treatment prior to the start of the Event. The Participant further undertakes to inform the Tutor of any possible medical complications (post-traumatic conditions, long-term illnesses, epilepsy, asthma, pregnancy, etc.). The Participant declares that he/she is not taking psychopharmaceuticals or other psychoactive substances. In case of participation in the Event on site, the Participant declares that he/she has no infectious diseases.

7.2 Prohibition of drugs and narcotics

The Participant declares that he/she acknowledges that it is prohibited to participate in the Event under the influence of drugs or other addictive, narcotic or psychoactive substances and undertakes not to use them before and during the Event.

7.3 Liability

Participation in the Event is voluntary. The Participant is fully responsible for himself and for all his actions throughout the duration of the programme. Instructions from the lecturer are only suggestions to be followed at the participant's own discretion. The Participant acknowledges that he/she may be subjected to physical, mental or emotional stress during the Event. Participants under the age of eighteen (18) must have the prior written consent of a legal guardian or custodian to participate in the Event.

Neither the Provider nor the trainer or therapist is in any way responsible for the consequences that may arise for the Participant or third parties in the application of the advice and recommendations presented during the Event or the Digital Product.

7.4 Interruption of participation

The Participant may leave the Event at any time at his/her own risk, knowing that the fee for the Event is non-refundable. The Lecturer has the right to terminate the Participant's participation in the Event if it deems it appropriate, in particular with regard to the safety of the Participant and/or other participants in the Event

or not to admit the participant to the Event in the event of a very late arrival. In this case, the Event fee will be refunded.

8. Processing of personal data and consent to the processing of personal data

8.1 All processing of personal data is carried out in accordance with the Personal Data Processing Policy, which complies with applicable legislation.

8.2 The Participant acknowledges that the provision of their personal data to the extent set out in the Personal Data Processing Policy is a contractual requirement necessary for the provision of the Service. Its provision is a matter of the Subscriber's personal will, but without the provision of personal data to the extent required, the Service cannot be properly provided.
